1. Acceptance of Terms

By accessing or using StackMail's services, website, or any applications (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

These Terms constitute a legally binding agreement between you and StackMail ("Company," "we," "us," or "our"). We may update these Terms at any time, and your continued use of the Services constitutes acceptance of any changes.

2. Description of Services

StackMail provides cold email infrastructure services, including but not limited to:

  • Google Workspace and Microsoft 365 mailbox provisioning
  • Domain registration and DNS management
  • Email deliverability tools and monitoring
  • Integration with third-party email sequencing platforms
  • Email warmup services

3. Account Registration

To use our Services, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least 18 years old to use our Services. By creating an account, you represent and warrant that you meet this age requirement.

4. Payment Terms

Certain Services require payment. By subscribing to paid Services, you agree to pay all applicable fees as described on our pricing page. All fees are non-refundable except as expressly stated in our Refund Policy.

  • Fees are charged in advance on a monthly, quarterly, or annual basis depending on your subscription plan
  • We may change our fees upon 30 days' notice
  • Failed payments may result in suspension of Services
  • You are responsible for all taxes associated with your use of the Services

5. Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with our Acceptable Use Policy and Anti-Spam Policy. You shall not:

  • Send unsolicited bulk emails (spam)
  • Violate any applicable laws, including CAN-SPAM, GDPR, or other anti-spam regulations
  • Use the Services to harass, abuse, or harm others
  • Transmit malware, viruses, or other malicious code
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use the Services for illegal activities, including fraud or phishing

6. Intellectual Property

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, and software, are owned by StackMail or its licensors and are protected by intellectual property laws.

You retain ownership of any content you submit through the Services. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content solely for the purpose of providing the Services.

7. Third-Party Services

Our Services may integrate with or provide access to third-party services, including Google Workspace, Microsoft 365, and various email sequencing platforms. Your use of such third-party services is subject to their respective terms of service and privacy policies.

We are not responsible for the availability, accuracy, or content of third-party services, and we do not endorse any third-party products or services.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Services will be uninterrupted, error-free, or secure. We do not guarantee any specific email deliverability rates or results.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STACKMAIL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

Our total liability for any claims arising from these Terms or your use of the Services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless StackMail and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice. You may terminate your account at any time by contacting us at support@stackmail.io.

Upon termination, your right to use the Services will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts located in Maharashtra, India.
